This website is operated by Montclair Ventures LLC, a New Mexico limited liability company, under the Gloimo brand. In these Terms of Service, “Gloimo,” “we,” “us,” and “our” refer to Montclair Ventures LLC.

These Terms govern your access to and use of gloimo.com, including purchases of products offered through the website. By accessing the website or placing an order, you agree to these Terms and to the policies referenced in them, including our Privacy Policy, Refund Policy, and Shipping Policy.

If you do not agree to these Terms, do not use the website or place an order.

Our online store is hosted by Shopify. Shopify provides the ecommerce platform that allows us to offer products and services to you. Payments may be processed by Shopify Payments or other payment service providers made available at checkout.

2. Eligibility and Lawful Use

You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to place an order unless applicable law permits otherwise.

You may use the website and our products only for lawful purposes. You may not use the website in a way that violates applicable law, infringes another person’s rights, interferes with website security, introduces malicious code, or involves fraudulent or misleading activity.

We may refuse, cancel, or limit an order when reasonably necessary to prevent fraud, comply with law, address inventory limitations, correct errors, or protect Gloimo, Shopify, our payment providers, or customers.

3. Dietary Supplement Information and No Medical Advice

Our products are dietary supplements and wellness products. Information on this website is provided for general informational purposes and is not medical advice, diagnosis, or treatment. It is not a substitute for advice from a qualified healthcare professional.

5. Orders and Order Acceptance

When you submit an order, you are offering to purchase the products shown in your order subject to these Terms. An order is accepted when we send an order confirmation or otherwise confirm acceptance.

We may cancel an order before shipment if the product is unavailable, the price or product information contains a material error, payment cannot be authorized, we reasonably suspect fraud or unauthorized activity, or fulfillment would violate applicable law.

If we cancel an order after payment has been collected and no product has been shipped, we will issue the appropriate refund to the original payment method.

6. Prices, Taxes, and Payment

Prices are displayed in the currency shown at checkout. Applicable taxes, shipping charges, discounts, and other charges will be shown before you complete your purchase whenever required by law.

By submitting payment information, you represent that you are authorized to use the payment method provided and authorize the amount shown at checkout to be charged.

Payment transactions may be processed by Shopify Payments and other payment providers. We do not control the independent processing activities of those providers. Their services may be subject to their own terms and privacy notices.

We may correct pricing or checkout errors. If a material pricing error affects an order that has already been submitted, we may contact you to confirm whether you want to proceed at the correct price or cancel the affected order and issue a refund.

7. Subscriptions and Recurring Billing

Some products may be offered through an optional subscription. A subscription is not required unless the offer clearly states otherwise.

Before you complete a subscription purchase, the checkout or offer will disclose the price, billing frequency, recurring nature of the charge, and applicable cancellation terms. By purchasing a subscription, you authorize us and our payment provider to charge the payment method associated with your subscription at the price and frequency disclosed at checkout until you cancel or the subscription otherwise ends.

Subscription pricing and frequency are based on the option you select and will be displayed before purchase. We will not enroll you in a paid subscription through a hidden or misleading selection.

You may cancel, pause, skip, or modify an eligible subscription through the customer subscription portal when available or by contacting us at support@gloimo.com. Cancellation stops future renewal charges once it takes effect. It does not retroactively cancel a charge that was validly processed before the cancellation became effective.

If we make a material change to an active subscription, we will provide notice when required by applicable law.

8. Shipping and Delivery

We ship to the destinations identified on the website and at checkout. Available shipping methods, estimated delivery timeframes, and applicable shipping charges will be disclosed through the website or checkout process.

Delivery dates are estimates unless we expressly state otherwise. Delays may occur because of carriers, weather, customs, demand, inventory, address problems, or events outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. If an order is returned because the address supplied was incorrect or incomplete, additional shipping charges may apply where permitted by law.

9. Returns, Refunds, Damaged Orders, and Cancellations

Returns and refunds are governed by the Refund Policy displayed on our website. The Refund Policy forms part of these Terms.

If you receive a damaged, defective, incorrect, or materially incomplete order, contact support@gloimo.com promptly with your order information and reasonable supporting details so we can review the issue and provide an appropriate resolution.

Approved refunds are returned to the original payment method unless applicable law requires otherwise. The time required for a refund to appear after processing may depend on the payment provider and financial institution.

Nothing in these Terms limits any nonwaivable consumer right provided by applicable law.

10. Accurate Billing and Account Information

You agree to provide current, complete, and accurate purchase and account information. You are responsible for promptly updating information when necessary so that we can complete transactions and contact you regarding your order.

We may limit or cancel quantities that reasonably appear to be placed by unauthorized resellers, fraudulent actors, or persons attempting to circumvent purchase restrictions.

11. Promotions, Discounts, and Availability

Promotions and discounts are subject to the terms displayed with the applicable offer. We do not guarantee that a promotion will remain available after its stated expiration or after inventory allocated to the promotion is exhausted.

Any statements regarding product availability, inventory, demand, customer activity, promotional deadlines, or savings are intended to reflect genuine information and not to create artificial urgency.

Unless clearly stated otherwise, promotional codes cannot be combined and have no cash value.

12. Reviews, Testimonials, and User Content

If you submit a product review, testimonial, photograph, comment, suggestion, or other content, you represent that the content is truthful based on your own experience, that you have the right to submit it, and that it does not infringe the rights of another person.

Payment information may be processed by Shopify and applicable payment providers in connection with transactions, fraud prevention, regulatory compliance, and related payment services.

If you opt in to marketing communications, you may withdraw your consent using the unsubscribe or opt out method provided in the communication or as otherwise described in our Privacy Policy.

16. Electronic Communications

By placing an order or creating an account, you agree that we may send transactional communications reasonably necessary to service your order or account, including order confirmations, shipping updates, subscription notices, and customer service messages.

Marketing email or text messages will be sent only as permitted by applicable law and based on any consent required for that channel. You may opt out of marketing communications using the method provided in the message.

You may not use the website or services to engage in unlawful, fraudulent, deceptive, abusive, infringing, or harmful conduct.

Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms limits liability that cannot lawfully be limited, including liability arising from fraud, willful misconduct, or other matters for which applicable law prohibits limitation.

To the extent permitted by applicable law, you agree to indemnify and hold Montclair Ventures LLC harmless from claims, losses, liabilities, and reasonable expenses arising from your unlawful use of the website, your violation of these Terms, or your infringement of another person’s rights.

We may suspend or terminate access to the website if you materially violate these Terms, engage in fraudulent or unlawful conduct, or create a security risk.

Provisions that by their nature should survive termination will remain effective after termination.

These Terms are governed by the laws of the State of New Mexico and applicable federal law, without regard to conflict of law principles, except to the extent that the mandatory consumer protection laws of your state of residence apply and cannot lawfully be waived.

If any provision of these Terms is held to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

25. Entire Agreement

These Terms, together with the policies and disclosures referenced in them and the information shown at checkout, form the agreement between you and us regarding your use of the website and purchases from Gloimo.

If a product page, subscription disclosure, checkout term, Refund Policy, or Shipping Policy contains a more specific term governing a particular transaction, the more specific term will control to the extent necessary to resolve a conflict.
